Terms of Service
Effective Date : October 15, 2025
1.1. Introduction
These Terms of Service (“TOS”) apply to the access and use of all of our web and mobile based applications, and use of our products and services. Peerhealth Technologies Private Limited ("Peerhealth Technologies" or “Peerhealth” or “Curamesh” or "We" or "Our") is the author, publisher and owner of the internet resource at www.curamesh.com with any subdomain thereof, mobile/tablet/console applications or other present or future electronic modes, web and mobile based applications, products and services (which are collectively referred to as “App”). Peerhealth has its registered office at 2nd Floor, 18th Main Rd, Jayanagar 9th Block, Jayanagar, Bangalore South, Bangalore- 560041, Karnataka.
By accessing, viewing or using the App or any of the content on the App, you indicate that you understand and intend these TOS to be the legal equivalent of a signed, binding written contract, and that you accept such TOS and agree to be legally bound by them. If you do not agree with the TOS, you are not granted permission to use the App and should exit immediately. Further, by impliedly or expressly accepting these TOS, you also accept and agree to be bound by Our policies, including the Privacy Policy, and such other rules, guidelines, policies, terms and conditions as are relevant under the applicable law(s) in India for the purposes of accessing, browsing or transacting on the App, or availing any of the “Services” (as described in Paragraph 1 below and shall include such other services that may be made available on the App in future), and such rules, guidelines, policies, terms and conditions shall be deemed to be incorporated into, and considered as part and parcel of these TOS.
The App is a platform that inter alia facilitates the provision of Services. The access and use of the App by users/visitors ("User(s)" or "you" or "your" or "yourself") for availing the Services inter alia by (i) Peerhealth Technologies, and/or (ii) other Peerhealth Users (“Other Users”); and/or (iii) third party doctor(s), medical service providers, other medical and healthcare professionals or institutions ("Medical Experts"), shall be governed in accordance with these TOS read along with the privacy policy set out at curamesh.com/privacy (together referred to as "Agreement").
In order to avail the Services in the App the Users would be required to register on the App. By accessing or using the App, registering, or by accepting, uploading, submitting or downloading any information or content from or to the App, or any other means of usage herein, the User shall be deemed to have read and agreed to these TOS and Agreement without requiring any other express, implied or other consent requirement in writing or otherwise.
Peerhealth Technologies reserves the right to add, modify, amend, cancel, limit, vary or change, either wholly, or in part, at any point in time, the Agreement, without prior notice. Further, Peerhealth Technologies reserves the right to withdraw, suspend, alter, modify, change or vary the App, the App features, the App content, Services or parts thereof, at its sole discretion, without prior notice. All modifications / amendments to the Agreement will be posted on the App and will become effective immediately upon such posting on the App. Your continued use of the App after such change or modification shall be deemed to be your agreement to the revised/modified Agreement. Please review the TOS and Privacy Policy regularly to remain informed of any change. If you do not agree to the Agreement, please discontinue using this App immediately
Use of App and Services
The App and Services are designed to enable Users to connect with Other Users and Medical Experts in order to discuss, and get advice about any health or medical related concerns. Users can create their own medical profile by providing details about their current health, and list previous medical and health related experiences in a chronological manner. Medical Experts on the other hand can use this App to create their medical professional profile, and display the services they provide. Medical Experts, Users and Other Users can write posts related to their personal medical experiences or other medical topics which can be read by anyone logged in to the App. We endeavour to provide a functional and convenient Services through our App, but we do not guarantee that your web browser, or mobile device will be compatible with the App or the Services or that the App and Services will be available uninterrupted or that any content will be error free. Peerhealth is not responsible for any interruption in Services or availability of App due to, but not limited to, changes or updates in User’s or Medical Expert’s profile update, network failure, or any other technical incident. Peerhealth reserves the right, at its sole discretion, to modify or replace all or any part of the TOS (including, without limitation, pricing and payment terms), or change, suspend, or discontinue all or any part of the Services or App at any time by posting a notice on the App or by informing you through any other modes of communication. It is your responsibility to check the TOS periodically for changes. Your continued use of the App or the Services following the posting of any changes to the TOS constitutes acceptance of those changes.
The App and Services are intended only as a platform to allow Users to share their own health-related experiences and to interact with Medical Experts and Other Users. All content on the App is for informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Peerhealth does not practice medicine, does not provide healthcare services, and does not recommend or endorse any specific tests, physicians, products, procedures, opinions or other information that may appear on the App. Use of the App does not create a doctor–patient relationship between You and Peerhealth, or between You and any Medical Expert solely by virtue of use of the App. Any interaction between You and a Medical Expert is between You and that Medical Expert only. The App must not be used for medical emergencies. In case of an emergency, You should contact the nearest hospital or emergency services in Your jurisdiction immediately. Peerhealth does not verify or guarantee the accuracy of any content (even if posted by Medical Experts) and that any reliance is at the user’s own risk.
The App may collect and store demographic, financial, contact, health records and any other type of information that you may provide. This information is collected, stored and processed as per our privacy policy published on the App. By signing up to the App the Users and Medical Experts consent that their contact number could be used by Other Users to connect and contact with them via Whatsapp. Users and Medical Experts are responsible for any personally identifiable information (PII) including but not limited to contact information, demographic data, health records and medical history etc they share on the app. Peerhealth is not responsible for sharing any PII on the App. The Users and Medical Experts represent and warrant that they have taken the appropriate consent from Other Users before storing, or sharing with any third parties, any information including but not limited to PII, health records, demographic information and financial information etc.
The Users and Medical Experts, by accessing the App, consent and agree that the App may store their personal information including but not limited to contact information, demographic data, health records and medical history etc. The App may use this information for purposes as per our privacy policy published on the App.
Eligibility
The User or Medical Experts hereby represents and warrants that you:
Are at least 18 (Eighteen) years of age or above and are fully able and competent to understand and agree the terms, conditions, obligations, affirmations, representations, and warranties set forth in the TOS. If You share information about a child or other individual, You represent that You are that individual’s parent or legal guardian or otherwise have all necessary authority and consent to share such information.
Have the right, authority, and capacity to enter into and to fully abide by all of the terms and conditions of this TOS, as far as age, jurisdiction, laws of land, etc. are concerned; and
Are not impersonating any other person and are using your actual identity;
Agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the App and Services.
Term and Termination
This TOS shall remain in full force and effect while you use the App or Services. Peerhealth may terminate your use of/access to the Appl or the Services (either case, in whole or part), in its sole discretion, at any time, without warning or notice to you.
Registration, User Profile & Provision of Services
As part of the registration process you will need to create an account, including a username and password, and create a personal profile (“User Profile”). It is your responsibility to ensure that the information you provide is accurate, not misleading and secure. You shall be responsible for keeping your credentials in safe custody. Peerhealth will not be liable for any losses or claims arising out of misuse of App or Services accessed with your credentials. You cannot create an account or username and password using the names and information of another person or using words that are the trademarks or the property of another party (including ours), or vulgar, obscene or in any other way inappropriate. We reserve the right with or without notice to suspend or terminate any account in breach. Medical Experts represent and warrant that they are licensed practitioners registered with the appropriate National and State regulatory bodies, and there are no legal or regulatory impediments which prevent you from practising in India.
Peerhealth may, but is not obligated to, conduct basic verification of Medical Experts (for example, verification of registration numbers with applicable medical councils). Any such verification is limited and does not amount to certification, endorsement, or guarantee. Peerhealth is not responsible for and does not control any medical or professional advice given by Medical Experts. Medical Experts remain solely responsible for compliance with all applicable professional and legal obligations.
To create a User Profile, you should:
Acknowledge and agree that you may be required to give information about yourself for your User Profile verification. In order to complete your User Profile, you will be required to inter alia provide your name/alias, email address, gender, mobile number, date of birth, place of residence etc. Any information provided by you to us should be complete and accurate to the best of your knowledge. We are not obliged to cross check or verify information provided by you and we will not take any responsibility for any outcome or consequence as a result of you providing incorrect information or concealing any relevant information from us.
You understand that it is your responsibility to protect certain information relating to your usage of the App including, but not limited to your username, password, email address, contact details, mobile number and OTP, if any. You are responsible for maintaining the confidentiality of the password and User Profile, and are fully responsible for all activities that occur under your password or User Profile
By creating an account, you agree to:
Receive certain communications in connection with App or Services including from or on behalf of the Third Party Service Providers
Receive notifications in the form of SMS, email or mobile notifications.
Peerhealth reserves the right to charge subscription and/or membership fees from a User(s), by giving reasonable prior notice, in respect of any product, service or any other aspect of the App anytime in future. The Services may be subject to certain limitations, such as, limits on disk storage space and, other limitations dependent on the Third Party Service Provider's engagement with Peerhealth.
Peerhealth, app, the software, or the software application store that makes the software available for download on a device may include functionality to automatically check for updates or upgrades to the software. Unless your device, its settings, or computer software does not permit transmission or use of upgrades or updates, you agree that we, or the applicable software or software application store, may provide notice to you of the availability of such upgrades or updates and automatically push such upgrade or update to your device or computer from time-to-time. You may be required to install certain upgrades or updates to the software in order to continue to access or use the App or Services, or portions thereof (including upgrades or updates designed to correct issues with the Services). Any updates or upgrades provided to you by us shall be considered part of the Services.
User acknowledges and agrees that (a) Services may be subject to certain limitations, such as, limits on disk storage space and, other limitations dependent on the Third Party Service Provider's engagement with Peerhealth. The Services may be subject to certain limitations, such as, limits on disk storage space and, other limitations dependent on the Third PartyService Provider's engagement with Peerhealth; and (b) if Peerhealth disables access to User account, User may be prevented from accessing the App or Services and that such User account details or any files or other content, which may be contained in such User account. Peerhealth also reserves the right to deactivate the User account in case of any foul, abusive, inappropriate language used in any functionality including reviews, comments, interaction with Peerhealth’s and/or Third Party Service Provider’s stakeholders.
Peerhealth may also prescribe certain limits on the use of the App and/or Services or storage of User Content or Peerhealth Content at its sole discretion without any prior notice to you while at all times complying with the Privacy Policy. In consideration for Peerhealth granting you access to and use of the App and Services, you agree that Peerhealth and its third party providers and partners may place such advertising on the Services or in connection with the display of User Content or Peerhealth Content, or information from the Services, whether submitted by them or others.
Data Confidentiality
Peerhealth may allow Users and Medical Experts to upload their existing medical records, maintain repository of reports received from ThirdParty Service Provider, text, files, images, photos, video, or any other materials and to inter alia enable the User to provide Third Party Service Provider rating/ feedback etc. (collectively, "User Content").
The User and Medical Experts undertake to share or allow sharing of User Content with Peerhealth at their own risk. Peerhealth reserves the right to retain such information for the purpose of providing Services to the Users. Peerhealth reserves the right, in its sole and absolute discretion, to determine whether User Content is appropriate; and to remove any User Content, without notice or liability to you, which it determines to be inappropriate. Without limiting the generality of the foregoing, the following is a partial list of the types of User Content that Peerhealth deems to be inappropriate:
Content belonging to another person and to which a User does not have any right to;
Content that infringes intellectual property of any party;
Content that contains nudity, violence, or offensive subject matter or contains a link to an adult website;
Content that includes racially, ethically, or otherwise objectionable language;
Content that is libellous, defamatory, or otherwise tortious language;
Content that contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines or executable files that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information of any person whatsoever; and
Content that involves commercial activities and/or sales without Peerhealth's prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes.
User Content must not:
Disclose another person’s personal or health information without their explicit consent;
Promote self-harm, suicide, eating disorders or other serious harm;
Constitute harassment, bullying, stalking, or threats;
Promote illegal activities, unapproved drugs, or treatments prohibited under applicable law.
By submitting, posting or displaying any User Content on or through the App, You grant Peerhealth a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to host, store, use, reproduce, modify (for formatting and technical purposes), publish, translate, create derivative works of, distribute, publicly perform and display such User Content in connection with operating, improving and promoting the App and Services.
6. User Guidelines:
Users and Medical Experts agree that they shall not:
And shall not permit anyone to: (i) copy or republish the App; (ii) make the App available to any person other than themselves, (iii) remove, modify or obscure any copyright, trademark or other proprietary notices contained in the App, (iv) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of App or (vii) access the App in order to build a similar or competitive product, or (viii) shall not access (or attempt to access) the App and the materials or services by any means other than through the interface that is provided by the Peerhealth.
Use any deep-link, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the App or content, or in any way reproduce or circumvent the navigational structure or presentation of the App, materials or any content, to obtain or attempt to obtain any materials, documents or information through any means not specifically made available through the App.
Attempt to gain unauthorized access to any portion or feature of the App, any other systems or networks connected to the App, to any server, or to any of the services offered on or through the App, by hacking, password mining or any other illegitimate means.
Probe, scan or test the vulnerability of the App or any network connected to the App, nor breach the security or authentication measures on the App or any network connected to the App.
Disrupt or interfere with the security of, or otherwise cause harm to, the App, systems resources, accounts, passwords, servers or networks connected to or accessible through the App or any affiliated or linked sites.
You accept that any and all operations emanating from your device shall be assumed to have been initiated by you.You shall request Peerhealth to disable your account and change the password immediately for the account, if your device (wherein App account may be signed in) has been lost or stolen.
You are responsible for any and all activities that occur in your account. You agree to notify Peerhealth immediately in the event of an unauthorised use of User account or any other form of security breach. Peerhealth shall not be liable for any loss to you or your organisation owing to negligent actions or a failure on your part to inform Peerhealth, within a reasonable time, about loss or theft of your device and/or any unauthorised access in your account, either with or without your knowledge. Further, you shall not use any other person’s account at any time, without an express prior written permission of the concerned account holder and Peerhealth. You shall be liable for losses incurred by Peerhealth or any other party due to a third party’s use of your account. You shall ensure that, while using the functions and features of the App, all applicable laws, rules and regulations shall, at all times, be strictly complied with by you. Peerhealth shall not be liable in any manner whatsoever for default of any nature by you.
You agree that the App may be linked to the website of third parties, affiliates and business partners and that Peerhealth has no control over, and is not liable or responsible for content, accuracy, validity, reliability, quality of such websites or made available by/through the App. Inclusion of any link on the App does not imply that Peerhealth endorses the linked website. Other Parties may use the links and these services at their own risk.
7. Deidentified Data & Data Ownership:
For the purposes of this TOS, "De-Identified Data" refers to health and personal information that has been processed to remove any personal identifiers or other information that could reasonably identify an individual. This includes the removal or alteration of direct identifiers (e.g., names, addresses, and medical record numbers) as well as indirect identifiers (e.g., dates of birth, and other data points that could potentially be used, in combination with other data, to re-identify an individual).
De-Identified Data is no longer considered Protected Health Information (PHI) under applicable privacy regulations, such as the Health Insurance Portability and Accountability Act (HIPAA), and is thus excluded from certain legal protections related to PHI. The data is anonymized in such a way that it cannot reasonably be re-identified, either alone or in combination with other available information. Peerhealth may use, share, or analyse De-Identified Data for purposes including, but not limited to, research, analytics, product development, and other business operations without the need for patient consent.
Ownership of personal data: Users retain ownership of any personal data provided to Company in connection with our services subject to the rights and permissions you grant us under this TOS.
Ownership of De-Identified Data: Peerhealth owns all rights, title, and interest in and to any data that has been De-identified or aggregated, as defined under applicable laws (e.g., HIPAA, GDPR).
8. Communication:
You agree to receive communications through emails, telephone, mobile phone and/or SMS, from Peerhealth or its third-party vendors or business partners or third-party service providers regarding the services or services updates, transactional and/or promotional emails and/or any announcements. In this context and regard, you agree and provide your consent to receive all communications at the mobile number provided to Peerhealth, even if this mobile number is registered under DND/NCPR list under Telecom Regulatory Authority of India (TRAI) laws, rules and regulations. And for that purpose, you further authorise Peerhealth to share/disclose the information to any third-party service provider or any affiliates, group companies, their authorised agents or third-party service providers. You also agree that in accordance with the applicable TRAI laws, rules and regulations specifically The Telecom Commercial Communications Customer Regulations, 2014:
Each time you do visit/transact or login in your account on the App, it shall be regarded as a verifiable request from you pertaining to receipt of our Services and activities;
Each time you visit/login/transact on the App, it will be deemed to be as a fresh request from you for continuing to receive communication from Peerhealth;
In case you do not wish to receive any communication from us or to provide your feedback about the services, you can mail us at support@curamesh.com
Peerhealth will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements entered into for providing Services and ancillary services.
9. Termination:
Peerhealth may terminate your access to all or any part of the App or Services at any time if you fail to comply with these TOS. This may result in the forfeiture and destruction of all information associated with your membership and will immediately terminate your ability to provide services through the App. All provisions of the TOS, which by their nature should survive termination, shall survive termination, including, without limitation, warranty disclaimers, indemnity and limitations of liability. In the event of discontinuation of services, Peerhealth, at its discretion, will make reasonable efforts to help you take a backup of your data in a suitable electronic format.
10. Disclaimer:
The app (including, without limitation, any content) are provided “as is” and “as available” and is without warranty of any kind, express or implied, including, but not limited to, the implied warranties of title, non-infringement, merchantability and fitness for a particular purpose, and any warranties implied by any course of performance or usage of trade, all of which are expressly disclaimed. Peerhealth and its directors, employees, agents, suppliers, sponsors and partners do not warrant that: (a) the service will be secure or available at any particular time or location; (b) any defects or errors will be corrected; (c) any content or software available at or through the service is free of viruses or other harmful components; or (d) the results of using the service will meet your requirements. your use of the service is solely at your own risk.
11. Indemnification:
You shall defend, indemnify, and hold harmless Peerhealth, its affiliates /subsidiaries /JV partners and each of its, and its affiliates/subsidiaries/JV partners employees, contractors, directors, suppliers and representatives from all liabilities, losses, claims, and expenses, including reasonable attorneys’ fees, that arise from or relate to (i) your use or misuse of, or access to, the App or Services, or (ii) your violation of the TOS or any applicable law, contract, policy, regulation or other obligation. Peerhealth reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with Peerhealth in connection therewith.
12. Limitation of Liability:
To the fullest extent permitted by law, in no event shall Peerhealth (nor its directors, employees, agents, sponsors, partners, suppliers, content providers, licensors or resellers, be liable under contract, tort, strict liability, negligence or any other legal or equitable theory with respect to the service (i) for any lost profits, data loss, loss of goodwill or opportunity, cost of procurement of substitute goods or services, or special, indirect, incidental, punitive, or consequential damages of any kind whatsoever, or substitute goods or services, (ii) for any direct damages in excess (in the aggregate) of the fees paid by you for the service preceding the applicable claim or (iv) for any matter beyond its or their reasonable control, even if Peerhealth has been advised of the possibility of any of the aforementioned damages.
13. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of India without regard to the conflict of laws provisions thereof. All claims, differences and disputes arising under or in connection with or in relation hereto the App, the TOS or any transactions entered into on or through the App shall be subject to the exclusive jurisdiction of the courts at Bangalore, India and you hereby accede to and accept the jurisdiction of such courts.
14. Miscellaneous:
The TOS are the entire agreement between you and Peerhealth with respect to the use of App or the Services, and supersede all prior or contemporaneous communications and proposals (whether oral, written or electronic) between you and Peerhealth with respect to the use of App or the Services provided. If any provision of the TOS is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the TOS will otherwise remain in full force and effect and enforceable. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. The TOS are personal to you, and are not assignable or transferable by you except with Company’s prior written consent. Peerhealth may assign, transfer or delegate any of its rights and obligations hereunder without consent. No agency, partnership, joint venture, or employment relationship is created as a result of the TOS and neither party has any authority of any kind to bind the other in any respect. All notices under the TOS will be in writing and will be deemed to have been duly given when received if personally delivered or sent by certified or registered mail, return receipt requested; when receipt is electronically confirmed, if transmitted by facsimile or e-mail; or two days after it is sent, if sent for next day delivery by recognized overnight delivery service.
